R.K. Pachauri granted anticipatory bail

The court has granted anticipatory bail on the basis of a prima facie view that no custodial interrogation is required

New Delhi: A district court in Delhi on Thursday granted anticipatory bail to Rajendra K. Pachauri, who recently stepped down as chairman of the Intergovernmental Panel on Climate Change (IPCC) in the wake of sexual harassment allegations by a research associate at the Delhi-based The Energy and Research Institute (TERI).

Pachauri denies the charges.

“The court has granted anticipatory bail on the basis of a prima facie view that no custodial interrogation is required. All conditions imposed by the court are normal and routine conditions to allow a free and fair investigation of the case," said a statement from Ashish Bhan, the lawyer representing Pachauri.

Such conditions would ensure that Pachauri stays in India for the duration of the investigation and made himself available for questioning when required. The hearing which lasted for two hours took place at Saket District Court in New Delhi.

These conditions would also mean that Pachauri cannot enter his TERI office for the duration of the investigation.

The next date of hearing is on 27 March.

TERI announced on Monday that Pachauri had gone on leave and that “adequate internal arrangements have been made to ensure the smooth operations of the organization".

After the announcement, several lawyers, academics and civil society members demanded the resignation of Pachauri in a letter to the governing council of TERI which was signed by social activists and advocates such as Indira Jaisingh, Syeda Hameed and Kavita Krishnan​​.

“We can only conclude that society cannot be changed by law alone and what is really needed is change in our actions and thoughts. It is for the leadership of organizations at the top level to demonstrate this change in their actions," said the letter.
